1.
All bookings must be on the official booking form and signed. If your form is accepted, you will be sent an Invoice for the correct amount. All pitches are booked in
the order that payment is received. Applications
will not be regarded as booked until such payment has been received.
2.
Public Liability Insurance: All applications must be
accompanied by a photocopy of a valid insurance certificate. Minimum
cover must be for £2 million per stallholder. This can be supplied up to the 1st July where expiry dates of said insurance dictates.
3.
Other Certificates: Any other relevant certificates held by the
stallholder should be copied and sent with the booking form (ie, food
hygiene, etc).
4.
BCC reserves the right to refuse any application without reason, though in this circumstance all fees received will be refunded with immediate effect.
5.
Cancellations: fees can only be refunded if notice of
cancellation is received more than 21 days before the event. We will also consider a full refund if the original stallholder is able to relet the pitch, subject to the terms above with regards to the new stallholder.
6.
The trading times of the Beccles Carnival are noted below and
stallholders are expected to be open all these times. with the
exception of any period where the
site may be closed for cleaning purposes.
Friday
18th July 6pm – 11.30pm
Saturday 19th July 1.30pm - 12.00am
Sunday
20th July 2pm – 11.30pm
Breakdown
MUST NOT begin earlier than 11pm on Sunday 20th July.
However, please note that the crowd drawn on the Sunday night
(Firework Finale) is usually very large.
7.
Access to the Site for set up purposes is only available from
noon till 10pm on Thursday 17th July and from 9am till 2pm on Friday 18th July.
Any Stallholder wishing to arrive outside of these hours MUST notify
BCC prior to the event and failure to do so may result in the refusal
of access until the hours stated.
8.
All pitches must be clear, cleaned and vacated by 12pm Monday 21st
July.
9.
Each Standard Pitch has a frontage of FIFTEEN feet width
and any requirement in excess of this frontage MUST be notified at the
time of booking on the Booking Form and the correct adjustment made to
the payment sent therewith. All fees are detailed on the Booking Form.
BCC reserves the right to refuse applications for extra frontage. BCC’s
decision as to the siting of any stall and/or vehicle therewith shall
be final and binding.
10.
All Stallholders MUST keep within the confines of the space allocated
to them.
11.
Any specific information about your stall or vehicle which is outside
the routine nature of such a stall or vehicle should be made known in
writing to BCC when booking a pitch.
12.
The Stallholder shall provide his/her own source of lighting and
power. Any flammable materials, ie, petrol, gas bottles and so on,
including the use of generators, must be notified on the booking form.
13.
The Stallholder is responsible for maintaining his/her site and the
keeping of the surrounding area safe and tidy and shall provide
sufficient waste bins and/or bags for such purpose. No trade rubbish
shall be deposited in Waveney District Council litter bins. Adequate
bins will be provided by BCC for that purpose.
14.
The Stallholder accepts sole responsibility for the maintenance and
security of his/her site and is, in addition liable for any damage
caused to his/her vehicle(s) and/or stall(s) howsoever such damage may
be caused.
15.
BCC reserves the right to use any site which is not occupied during
the Carnival without notice or refund and may, at its sole discretion,
prohibit the sale of any item, goods or services from any stall and by
any Stallholder.
16.
All bottled drinks must be served in plastic drinking containers and
Stallholders will be liable for any accident caused by their failure
to obey this condition.
17.
Any claim(s) arising from, or relating to the product(s) and/or
services provided and or/sold by the Stallholder shall be the
responsibility of the Stallholder.
18.
The costs of any repairs and/or maintenance to the Stallholder’s
site which is required by Waveney District Council to be initiated by
BCC will be invoiced to the Stallholder at cost after the repairs have
been effected.
19.
All Local Authority Bylaws and Statutory Notices, particularly but not
exclusively, in respect of safety, hygiene, food preparation and
storage shall be obeyed by the Stallholder and he/she shall be solely
responsible for answering to the Authorities should a breach occur.
20.
A condition of the use of the Beccles Quay and any other Local
Authority venue is subject to the terms and conditions of use imposed
from time to time by Waveney District Council. BCC is the first party
to these conditions but imposes, as the second party, the Stallholder,
vendor or person(s) providing entertainment on the site. In
particular:-
(a)
Unauthorised fly-posting is not permitted and may result in
prosecution. Any Stallholder responsible for fly-posting will be
enjoined in the prosecution and BCC will seek to recover the costs of
removing said posters from the person(s) responsible.
(b)
The giving of goldfish as prizes is expressly forbidden.
(c)
All food/catering units MUST be registered with their home Local
Authority and evidence of such should be copied and sent with your
application. Any unit not so registered will be removed from the site immediately and no fees will
be refunded.
(d)
Stallholders shall have their own Insurance cover (minimum £2,000,000
cover) and are required to enclose a copy of the Certificate with
their booking application and have one to hand to show to safety officials of
Waveney District Council, the Suffolk Fire Service or any other
properly interested official. Such Insurance shall indemnify BCC
against all and every claim for damage, negligence and/or injury.
21.
No pitch may be occupied until BCC has confirmed acceptance of a
signed booking form from the Stallholder and ALL fees due have been
paid.
22.
BCC and it’s duly appointed Site Manager and/or other appointed
representatives, have total overall control of the whole site and BCC
may, particularly but not exclusively, in conjunction with the Police,
Fire or Safety personnel, make additional conditions where it is clear
to it, or from the advice it has received, that such condition is
necessary to protect the safety and health of the public. Such
additional conditions are equally binding upon the Stallholders.
23.
Any breach of these Booking Conditions shall render the Stallholder
liable to removal from the site and, in such circumstances, no refund
of fees will be made.
24.
All Schedules, as well as the completed booking form, which attach to
these Booking Conditions shall form part of the Stallholder’s
contract with BCC.
